When we use terms like “Gözen Digital”, “GDA”, “we,” “our,” or “us” in these Terms, we’re talking about Gözen Technology and Informatics Inc. (in Turkish, Gözen Teknoloji ve Bilişim Anonim Şirketi) and our group companies.

By using Simorg, you agree to these General Terms & Conditions (“Terms”) as well as the additional policies linked here and on the Product.

Please be informed that these Terms set forth the relationship between you and us from a general perspective. If you have any other kind of relation with us (such as a specific agreement, sales agreement, etc.), the provisions of the relevant specific agreement shall prevail in case of any conflict with these Terms.

Simorg is improving and evolving. From time to time, we may make changes to the Product or these Terms.

We may need to change these Terms to reflect business updates, changes to the Product, legal or commercial reasons, or otherwise to protect our legitimate interests.

We can make these changes at any time, and it’s your responsibility to check these Terms now and then for any changes.

Your continued use of the Product after any changes to the Terms is taken as your acceptance of the revised Terms.

All rights, including all kinds of Intellectual Property (IP) Rights, related to the Product (referred to as “Simorg IP”), are exclusively owned by GDA or our licensors. You do not acquire any rights in the Simorg IP, and you are not allowed to use it, including our brand name or logo, for any purpose without our prior written approval, such as implying a partnership or endorsement from GDA.

As a user (including beta users, etc.), we grant you a limited, revocable, non-exclusive, and non-transferable right to use the Product in accordance with these Terms.

Please don’t remove, hide, or alter any proprietary notices or trademarks on the Product. Copying, reproducing, distributing, licensing, selling, reselling, modifying, translating, disassembling, decompiling, decrypting, reverse-engineering, or attempting to derive the source code of the Product or any part of it is strictly prohibited

The Product includes open-source software components, and some of these components are subject to their own specific license terms. You can find these terms in our Third-Party License Notice, which is also accessible in the Product

If the license terms of a particular open source component don’t align with our terms outlined here or if it is not the last updated version, then these Terms won’t cover that component. Instead, this component's relevant/most updated license terms will govern your rights and responsibilities for that specific component.

From time to time, we may share information with you that is confidential (e.g. we may reveal new and upcoming features to you if you take part in beta testing with us). If you are participating in a Beta trial, and there is information we are comfortable with you sharing publicly as part of your participation, we will make that known to you. Otherwise, all information is required to be deemed confidential.

Simorg is provided 'as is' without warranty of any kind. GDA excludes all warranties, either expressed or implied (including, but not limited to, any implied warranties of merchantability, fitness for a particular purpose, satisfactory quality, or freedom from hidden defects).

Any person relying on the Product or making any use of it shall do so at their own risk.

To the fullest extent permitted by the applicable law, GDA hereby disclaims any liability, and in no event shall GDA be liable for any damage including, without limitation, direct, indirect, or consequential damages including loss of revenue, loss of profit, loss of opportunity or other loss arising from the use of or the inability to use the Product including damages arising from inaccuracies, omissions or errors.

We love hearing your ideas on how we can make Simorg even better! Sometimes, we may make “beta” functionality available to you and seek your feedback.

Please be informed that if you share feedback with us, we’re free to use it however we like, without payment to you (or to not use it at all) as per these Terms.

We may from time to time make certain functionality of the Platform available to you in “beta” (or similar). You acknowledge that we are still evaluating and testing such beta functionality and it may not be as reliable as other parts of the Platform.
